How does having a home abroad affect my Will?

In recent years, the thought of having a holiday or second home abroad has appealed to an increasing number of Brits, who, instead of paying a travel agent each year, have invested money in bricks and mortar in their destination of choice.

If you have a second home in a different country, this does not change the fact that you are a UK citizen, even if you spend several months out of the UK each year.  What you must remember, however, is that you may need to not only have a Will written in England, but also one written in the country where your second home is based, so that it is clear who is to benefit from the sale of this asset.

Both terminology and probate laws will obviously vary from country to country.  For example, in the US, a scheme known as the Medallion Stamp Guarantee is widely used, although it may be that you may not even need a second Will at all.  Each circumstance is different, so you’d be well advised to contact an experienced Will writer and probate specialist, who has worked with instances such as these in the past.
