What are the challenges when applying for probate?

There are many difficulties that you may have to face if you have been tasked with standing as an executor and have to probate a will. In the first instance there is the raft of documentation involved that you are required to manage. This will include having a copy of the will itself, having a number of copies of the death certificate, and completing the application forms which need to be submitted to the probate registry.

In order to complete probate you will also need to manage the estate. This can be a very complex and time consuming process. In addition to gathering in all of the assets, which may include bank accounts, insurance payments, and deeds for properties, this process will also require you to pay all of the debts owing on the estate. These may include payments to creditors, mortgages and inheritance tax, amongst others.

The whole process requires considerable amount of skill and, given the weight of legal documentation involved, it can provide a considerable headache for even the most organised of individuals. This is why, when people are asked to act as an executor of a will, many turn to solicitors. In doing so they are sacrificing a considerable amount of the estate’s wealth as legal bills for the administration of a will are expensive.

By far the best option for the administration of a will is to find a fixed-fee, low-cost option. If you would like to find out more then why not contact our free probate advice helpline: 0800 612 6105. Lines are open 7 days a week until 10pm.
