How to Choose a Probate Practitioner

As you will no doubt have already noticed if you are shopping around, probate fees can vary enormously, and there are various different reasons for this. When you are trying to decide upon the service that is right for you, there are a few things that you should bear in mind in order to make an informed decision.

The value of the estate

Some probate practitioners and banks base their fees on the value of the estate, taking a percentage of it upon resolution, which can vary from 1-5%. This means that the fees due on an estate worth £200,000 could total up to £10,000 on their own, regardless of the amount of work involved in the process. Ultimately, this payment system penalises those administering higher value estates, and such companies often have a lower value threshold in place as well, which prevents the administrators of lower-value estates from benefitting from potential savings.

The amount of work involved in executing an estate depends on how complicated the whole situation is-such as how many beneficiaries are involved, what sort of assets are involved, and how they are spread around. For instance, dealing with cash funds held in multiple bank accounts or overseas accounts will of course generate more work than handling a simple lump sum held in just one UK banking institution.

Additionally, if the Inland Revenue requires a full account of the estate, this can be complex and time consuming in and of itself.

Rates Determined Upon Completion

Agreeing to work with a probate practitioner without first agreeing upon a final fee can be perilous, as giving a solicitor or probate professional carte blanche to set their own charges without your formal agreement can leave you holding an extremely hefty bill. It is always wiser to agree upon a fixed rate in advance, to avoid any nasty surprises down the line.

Hourly Rates

The same tends to be true when hiring someone on an hourly basis, when you consider how hourly billing within the legal profession is generally handled. For instance, a five minute phone call can cost upwards of £30, or simply composing and sending off a letter can cost well north of £50.

Taking into account the fact that probate is rarely quick and can often drag out for months (or even years in some cases) and you might find yourself with little money left in the estate after all of the various probate fees have been covered.

The services offered by various different probate professionals can vary considerably, so make sure that you find out exactly what any quote for a service actually includes. For example, some companies will charge for the whole probate administration process from start to finish, while another firm asking a similar rate may simply make the application to the probate registry on your behalf and then leave you with the rest of it.
